Earl Poulett Dorsetshire NAISH #DB70. This is one of a number of ephemera - paperwork - documents items from the 16th-20th Century that came from the David Battie collection I am currently selling. David Battie well known for being a specialist of Asian ceramics and often seen on Antiques Roadshow. He collected ephemera, pictorial sheet music and engravings too and over the next few months I will be listing some of his collection so this all has good provenance.  Please see the others all with my prefix #DB Please note: I have added 17 large photos to the bottom of this listing to try and show the item in as much detail as possible so please take the time to view them all carefully. This is a very interesting a UNIQUE one off hand written transcript - manuscript document which has been bound and made into a book for easier reading.  It has a yellow like paper covering simple boards of a black grey colour of low quality stiff board. The early Georgian paper is nice quality as you find on documents of this period and is joined together with 3 large cords hinges on the spine sewn in. A single bit of paper is 16 and a 1/4 inch x 13 inch and with documents of this period the paper has been folded in half to give pages within this book. There are 24 pages in the book which are folded in half.  Before it has been made into a book the page of paper has been folded again as you find in boxes of deeds at solicitors etc. So you can see the original folds down each page as well. So originally the document has been deep 13 inch tall x 4 and 1/2 inch wide.  The first page as you open it as a book you will see the writing is written the normal way says Phillips Ms 20945 and some other numbers down at the bottom with Poulett. The inside of this page is blank and turn it over again and you will see this has been the ORIGINAL outer wrapper of the hand written transcript - manuscript document. The paper is grubby and black stained from being on the outside it has hand written wording   DORSETSHIRE  The King v  Earl Poulett -  Brief for  Earl Poulett.  Right at the bottom of this page it has the name Porter.  There are HOLES in these pages where they have been originally tied together or filed. Each page now has very fine cream coloured thread which can be seen when opening each page in the fold.  These paper pages have the fine white lines within the paper as well as watermarks which is an oval with a crown with a sat lion holding a staff on one side and 3 initials J&HM dated 1831.  Given the date of the paper 1831 and the first date on the document 1812 this must be a copy document of the proceedings written out a number of years later unless of course the watermark number 1831 is not a date. It matters not too much really that bit. If this relates to 1812 then it is King George III against Earl Poulett.  The next page when you turn it you can see the book now has to be turned on to the side to READ ALL  the pages. Each bit of paper has been written on by hand in a very nice sepia coloured ink. Very nice writing which 99% of it can be read by me. Large header at the top  The King against Earl Poulett. Brief for Earl Poulett At the far left hand side there is a margin of just over 3 inch and ever so often it has headings and notes in here as you go through each page. Each page is numbered at the bottom centre.  So it says DORSETSHIRE and then starts on the same line ... to wit - By a ? Inquest taken at Lyme Regis in the Co ( county ) of Dorset on the 14th Oct 1812 upon the Oaths of 12 good and lawful men of the sd Coy before ? Commissioners of His Majesty by virtue of a Common dated the 28th day of July then last it was found amongst other things.  That John Follett late of Garden Court in Middle Temple London Esq, decd, in the Common named and born illigitimate..... it then goes on about this gentleman John Follett and capital at Barton Farm and another farm called NAISH Farm.  It seems that Earl John Poulett has a claim to the land I think !? John Poulett was Lord of the Manor of Marshwood. It mentions Barton Farm quite a lot as well which was near Naish Farm and various parcels of land and meadows. It has By the Replication and has 1 - 6 issues all written down which vary in length but all say pretty much the same. At the bottom of page 4 it has a header called CASE. It then read .... The subject of the present proceedings is an Estate called Naish and or at Shave 188 acres in the parish of Marshwood in Dorsetshire late the property of John Follett Esq, deceased, who was for many years clerk of Assize for the ? circuit. Mr Follett who was illigitimate died on 13th Feb 1812 unmarried te intestate and without issue. Lord Poulett  as Lord of the Manor of Marshwood claims this estate as an Escheat ? (  the reversion of property to the state, or (in feudal law) to a lord, on the owner's dying without legal heirs )  as it forms part of the Manor evidenced by a ? and then there are more shortened words in respect of it from time to and the the present Lord Poulett and his ancestors.   So that is interesting.  The Crown has now set up a counter claim ..it then goes on to say that they are going to consider the nature of the issues and write more info down to assist in arranging evidence on behalf of his Lordship. It starts with ... The First Issue states in subsistance that there is no such ancient Manor as the Manor of Marshwood. 2nd That Naish and Shave are not situated within the Manor of Marshwood. 3rd that Naish and Shave are not held of the Manor of Marshwood. 4th That Lord Poulett is not tenant for life of the Manor of Marshwood. 5th That Naish and Shave were not held by Follett of Lord Poulett as Lord of the Manor of Marshwood. 6th That Naish and Shave were held by Follett of the Crown.  Notwithstanding 6 issues are joined on his Lordships traverse it is conceived that the evidence may be arranged under the heads and then it goes on to repeat the issues.  Then in the margin it has a date 25th Feby 35th Henry 8th - King Henry the 8th by Letters Patent of this date granted to his then Queen Catherine amongst other things for her life The Lordship and Manor of Marshwood otherwise called Marshwood Vale in the County Dorset and those his parks of Marshwood and then carries on like that in smaller hand writing. The word Escheat is underlined.  It then gets more interesting with more dates in the left margin and King Henry the 8th and Queen Catherine died at Sudley in Gloucestershire , 2nd Oct. 1st Edward 6th King Edward the 6th by his Letters Patent of this date granted unto John Duke of Northumberland the said Manor of Marshwood hundred.  The we move on to Queen Mary first year of reign and the said Duke of Northumberland was convicted and attained by Act of Parliament of High Treason and all his Manor Land possessions  chattels and Estates in Queen Mary and her heirs and successors.   24th October 1st Mary Queen Mary by Letters Patent this date gave and granted unto Gertrude Marchioness of Exeter the Manor of Marshwood and it goes on once again to describe the estate and the word Escheat is once again underlined. Then 28th Elizabeth it mentions Sir Amias Poulett and the Manor of Marshwood.  4th and 5th Phillip & Mary seems a chap called Anthony Harvey Esq had the Manor of Marshwood for term of life and in the same sentence Margarett Poulett daughter of Anthony Harvey and wife of Amias Poulett Esq. This is where it seems to get complicated with various names and heirs of various people come into play. It seems to have been split into 3 parts the Manor of Marshwood. A cousin and heir of the Marchioness of Exeter is now involved.  It then goes on to say that Lord Poulett and his ancestors have held a Court Seel in the hundred of Whitechurch. And it was a court held at a house called Prime Court within the hundred of Whitechurch in the Manor of Marshwood. It may be objected there is no Court Baron held for the Manor of Marshwood and they are arguing the point that this Prime Court was in fact a Baron Court.  Mr Beagly is the present Steward for Lord Poulett and various other witness's have had their say as well within the document.  The present Earl Poulett ( then Lord Viscount Hinton ) on the marriage with Sophia Pocock and her father George Pocock and another chap called John Pollexfen, Bastard and George Byng of the 4th part, which was all in 1782. Then more dates down the left margin from 1782 to 1806 is a Nathanial Middleton and the next page has more info from 1805 to 1813 where it sort of comes to an end that section. Right at the bottom of the page it talks about EXTRACTS from records of office copies of info and these start with Edward 1st period John De Maundeville at the time of his death he held the Manor of Marshwood and we are talking here of the Medieval period 1272 - 1307.  It gets really interesting reading from here down through the period of time and the English monarchs and who had the said land at the time. It even has The Will of the Marchioness of Exeter.  Page 13 has a header PROOFS which is a small statement from a local inhabitant as a witness and its got a name John Genge on the right hand margin and he was a Hundred Bailiff of the said Manor of Marshwood. Other witnesses are named too with statements which is all interesting reading these people are called Thomas Gillingham - John Matthews - John Hallett - James & Aston Hunt - Robert Dally - George Hoddel - Thomas Beagly - Robert Cox - Thomas Lane - George Vanderzee - The Reverend Drew - John Summers - Perham formerly a tenant of Naish Farm - Lawrence Millar - Henry Smith aged 82 years - Mr Thomas Stase of Beauminstoe - Mr Bernard Cox - Mr Lanson of Hawkechurch. This is the last page and it has only a small amount of hand writing at the very top of the page. Interesting though it says that Witness lived at the sign of the Bottle ( 3 fields from Naish ) 32 years. Has heard old people say that Naish farm ( except New Close ) is in the Manor of Marshwood that Lord Poulett had a right to hunt Hawk and Course over the same and also that Lord Poulett was always P and acknowledgment. The witness name being Mr Lanson of Hawkechurch.                   From what I can see, this document is a brief for Earl Poulett from the Dorset in regards to land and buildings that should be given back to The King since Poulett's heir is illegitimate. Please see photographs provided for more details and visual confirmation of condition. There are normal signs of age and use wear, especially on the edges, corners, and a ny creases. The pages are not cut straight on the edges and there is some discolouration on the surfaces. It measures approx. 13 and 1/2 inches x 8 and 3/4 inches. Very interesting local Devonshire manuscript transcript document which I very much doubt there are any more of these. John Poulett was 4th Earl Poulett 1756 - 1819 known as Viscount Hinton between 1764 - 1788 and he was a British Peer and Militia Officer being Colonel of East Devon Militia and Lord Lieutenant of Somerset. The farms are called Naish and Shave Park farms in the parish of Marshwood. Ideal document for a local county archive or for the serious local history collector of such material. Or even for a person that is related to any of the named people within the manuscript or for the current occupants of Naish Farm.
